In legal English, a threshold issue, or threshold matter, is something that a court must decide first, before proceeding to other issues. For example, in resolving a contract dispute where there are parties from different jurisdictions, which law will apply to the contract is often a threshold issue. In Constitutional law cases, the issue of standing is often a threshold matter that courts must decide before addressing other issues.
